General Terms and Conditions


1. Scope of application

These General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all contracts between Shellfish Housing GbR (hereinafter referred to as “Provider”) and the customer (hereinafter referred to as ‘Customer’) for the rental of holiday apartments for short-term and long-term use.


2. Conclusion of contract

2.1 The presentation of our holiday apartments on the website does not constitute a legally binding offer, but rather a non-binding invitation to submit an offer.

2.2 The contract between the Provider and the Customer is concluded when the Customer submits a booking request and the Provider accepts it. The booking confirmation is sent in writing by email.


3. Terms of payment

3.1 The rent for the booked holiday apartment is to be paid in accordance with the information on the website. Payments are to be made in euros.

3.2 The customer undertakes to pay the total amount of the booking in accordance with the terms of payment. For short-term bookings, full payment may be required at the time of booking.


4. Cancellation

4.1 The customer may cancel a booking free of charge up to a certain point in time. The exact cancellation conditions are available on the website and may vary depending on the holiday apartment booked.

4.2 Cancellations outside the free period may incur cancellation fees, which are also specified on the website.


5. Liability and compensation

5.1 The customer is liable for all damage caused by them or their fellow travellers. The provider is entitled to offset any damage incurred against the deposit paid.

5.2 The provider is liable for damage caused by gross negligence or intent on their part.


6. Data protection The provider collects, processes and uses the customer's personal data only within the framework of the statutory provisions and data protection guidelines. Further information on this can be found in the privacy policy on the provider's website.


7. Final provisions

7.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

7.2 Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.

7.3 The place of performance and jurisdiction for all disputes arising from the contractual relationship is the registered office of the provider, provided that the customer is a registered trader, a legal entity under public law or a special fund under public law.
